Sam Smith on Tom Petty Settlement: 'Similarities' But 'Complete Coincidence':

Over the weekend, The Sun reported that Sam Smith had quietly and amicably settled a copyright dispute with Tom Petty over the likeness between Smith's three-time Grammy-nominated "Stay With Me" and Petty's Full Moon Fever hit "I Won't Back Down," co-written with ELO's Jeff Lynne. In a statement to Rolling Stone, Smith's reps have confirmed that "Stay With Me" is now co-credited to Petty and Lynne, adding that while there are undeniable "similarities" between the two singles, it was a "complete coincidence."

"Recently the publishers for the song 'I Won't Back Down,' written by Tom Petty and Jeff Lynne, contacted the publishers for 'Stay With Me,' written by Sam Smith, James Napier and William Phillips, about similarities heard in the melodies of the choruses of the two compositions," Smith's rep tells Rolling Stone. "Not previously familiar with the 1989 Petty/Lynne song, the writers of 'Stay With Me' listened to 'I Won’t Back Down' and acknowledged the similarity."

Smith's rep added, "Although the likeness was a complete coincidence, all involved came to an immediate and amicable agreement in which Tom Petty and Jeff Lynne are now credited as co-writers of 'Stay With Me' along with Sam Smith, James Napier and William Phillips."

A representative for Petty was not immediately available for comment.

On the ASCAP site, where songwriter information is collated and frequently updated, Petty and Lynne are now listed among the "Stay With Me" team of Smith, Napier and Phillips. It's unclear whether Petty and Lynne were retroactively compensated for their songwriting credit or if they'll receive future earnings on the track.

Despite getting writing credit, however, Petty and Lynne will not be eligible for a Grammy should Smith win any of his multiple nominations for the track. "Since Lynne and Petty did not do any new writing for this work, we are considering their original work to have been interpolated by Napier, Phillips and Smith for 'Stay With Me,'" Senior Vice President of Awards Bill Freimuth told the Wall Street Journal. "Lynne and Petty will not be considered nominees nor will they be considered GRAMMY recipients, should the song win. Rather, they would be given certificates to honor their participation in the work, just as any other writers of sampled or interpolated work."

Gregg Allman recently wrapped up his first post-Allman Brothers Band solo tour, but the "Whipping Post" singer has already made plans to get back out on the road with a newly announced spring tour. While Allman's January trek saw the rocker circling the southeastern United States, his next tour will travel from Ohio and Iowa to Los Angeles and Austin.

Among the notable stops on Allman's tour include two nights at Chicago's House of Blues on March 19th and 20th, an appearance at Indio, California's Stagecoach Festival and an April 24th gig at Los Angeles' famed Roxy Theatre. After three shows in Texas, the 21-date tour will culminate with a May 9th performance on the Austin City Limits stage.

Like his previous trek, Allman will be joined on the road by guitarist Scott Sharrard, Peter Levin on keys, drummer Steve Potts, percussionist Marc Quinones, bassist Ron Johnson and horn players Jay Collins, Art Edmaiston and Marc Franklin.

The Allman Brothers Band concluded their 45-year run together in 2014 with a string of shows at New York's Beacon Theatre, the venue that frequently hosted the band's legendary residencies. The Rock and Roll Hall of Fame band performed their final gig together on October 28th, 2014.

UPDATE: Read our exclusive interview with Blink-182's Mark Hoppus and Travis Barker over the band's inner turmoils and their thoughts on "ungrateful, disingenuous" Tom DeLonge.

Tom DeLonge, longtime guitarist and co-vocalist of the punk trio Blink-182, has left the group, his bandmates announced in a statement Monday. Suspicions began when the band revealed that Alkaline Trio guitarist/singer Matt Skiba was recruited to join Blink-182 at the group's upcoming headlining set at drummer Travis Barker's eighth annual Musink Festival on March 22nd in Orange County, California, KROQ reports.

Soon after, Blink-182's Barker and bassist/singer Mark Hoppus issued a statement that DeLonge decided to "indefinitely" leave the band. "We were all set to play this festival and record a new album and Tom kept putting it off without reason," Hoppus and Barker said. "A week before we were scheduled to go in to the studio, we got an email from his manager explaining that he didn’t want to participate in any Blink-182 projects indefinitely, but would rather work on his other non-musical endeavors."

Hoppus and Barker continued, "No hard feelings, but the show must go on for our fans." It's unclear how long Skiba will collaborate with the remaining Blink members, but Alkaline Trio fans can breathe easy: Barker and Hoppus promise Skiba will continue to record and tour with his own band.

At press time, DeLonge had not commented on social media about his split from Blink-182, but he has been active in recent weeks promoting new music from his other band Angels & Airwaves. Shortly after his decision to leave Blink-182, however, DeLonge posted a selfie on Instagram with a sundown in the background. Hoppus tweeted shortly after the announcement, "Blink-182 for life. For life."

After taking a four-year hiatus from 2005 to 2009, the reunited Blink-182 toured frequently and recorded one album, 2011's Neighborhoods. Rolling Stone talked to DeLonge and Hoppus in September 2013 about whether the band had begun work on their next album.

"The way we always work is Mark and I pick up our acoustic guitars in our living rooms with our families," DeLonge said. "And once we start getting little things together, you'll see text messages and emails, then managers get involved and then everyone needs to talk and then we're on tour talking, so we're three or four steps in, so the actual getting onto the same room and tracking that has not happened yet, but that's pretty soon. That's probably the next step, to be honest."

If you want to "Party Like It's 1989" to "This Sick Beat," you better ask Taylor Swift's permission first. The pop star has trademarked those phrases – along with "'Cause We Never Go Out of Style," "Could Show You Incredible Things" and "Nice to Meet You, Where You Been?" – with the U.S. government, according to the legal database Justia (via Vox).

The filings prohibit the use of those phrases, which all cull from her 2014 album 1989, from appearing without a license on everything from guitar straps and other accessories to removable tattoos. Some of the more obscure – and likely obligatory – items covered by her trademarks include typewriters, walking sticks, non-medicated toiletries, Christmas stockings, "knitting implements," pot holders, lanyards, aprons, whalebone, napkin holders and the particularly ominous collection of "whips, harness and saddlery."

For reference, feel free to cut and paste the special characters ™ and ® for future references to 1989.

In other Swift news, the singer's Twitter and Instagram accounts were recently hacked, with multiple posts attempting to convince her 51 million followers to follow other Twitter users. The social media service quickly deleted the fake tweets and Swift referenced her own "Shake It Off" with the joke, "Hackers gonna hack hack hack hack hack."

The singer expressed her concerns of privacy and security last year in her Rolling Stone cover story. When the magazine asked her who she thought might be spying on her, she said it could be anyone. "The janitor who's being paid by TMZ," she said. "This is gonna sound like I'm a crazy person — but we don't even know. I have to stop myself from thinking about how many aspects of technology I don't understand."

Kate Spade & Company is having a big news day. After announcing plans to close all the Kate Spade Saturday and Jack Spade brick and mortar stores, the company reaffirmed its goal to become a powerful global lifestyle brand that reaches customers at all phases of their lives. Next up: a children's line.

"We saw early promise in childrenswear, including our collaboration with Gap Kids for the holiday season, and we are excited for the debut of the Kate Spade children's collection in the next few weeks," said CEO Craig A. Leavitt during an earnings call Thursday morning.

It is yet unclear whether this line will be sold as its own label at Kate Spade New York stores or if Jack Spade will be involved with the boys' collection. Requests for more information from the company's representatives were not immediately returned.

As Leavitt mentioned, Kate Spade New York and Jack Spade announced plans last April to partner with Gap Kids on a limited-edition collection for children, which arrived in stores in time for the holidays and featured candy cane-striped tights and camo sweatshirts in prices ranging from $20 to $130. Some items are still available here. It was the first foray into childrenswear for the sibling brands—stay tuned to see if the new collection builds on the same aesthetic.
